Full Terms & Conditions

1. This Promotion is open to residents of the United Kingdom aged 17 or over who hold a valid full UK driver's licence, excluding employees of the Promoter, its agents and anyone professionally associated with this Promotion.
2. No purchase necessary; however, internet access, a valid Instagram account and a valid UK driving licence are required.
3. Promotion Period: Enter between 09:00 BST on the 2 August 2023 and 23:59 BST on the 8 August 2023 inclusive.
4. To Enter: Log onto your Instagram account (or create one for free), follow @autotraderuk, locate the promotional post of the Smart ForTwocar, like the post and comment underneath with your guess as to how many potatoes are in the car and use the hashtag #ShowOnTheRoadGiveaway to be entered into the Promotion.
5. You must keep your account on a public setting and continue to follow @autotraderuk on Instagram for 4 weeks after the end of the Promotion Period in order to be contacted if you are selected as a winner.
6. Unlimited number of entries is permitted per person during the Promotion Period. No person may win more than 1 Prize.
7. The Prize: There will be 1 winner. The winner will win 1 x white Smart ForTwo Ultimate car.
8. Further Entry & Prize Details and Conditions:
   1. The winner must be aged 17 or over at the time of entering the Prize Draw.
   2. The winner must have and must show a full driving licence valid in the UK. In certain circumstances the Promoter may waive this requirement where the winner can show (to the Promoter’s reasonable satisfaction) that the winner is unable to drive due to a disability or medical condition but wishes to own a car for a carer to use for the winner’s benefit.
   3. The winner will be asked to prove they are a resident of the UK
   4. The prize will be available for home delivery or collection (travel expenses will be reimbursed by Auto Trader up to £200)
   5. If the prize is to be driven on a public highway, insurance cover must be obtained by the winner prior to collection of the Prize.
   6. The Promoter cannot guarantee that the vehicle will not be pre-registered to the Promoter or it’s associated companies.
   7. Maintenance, insurance, services and running costs (including obtaining, installation and use of charging points) of the vehicle are the responsibility of the winner from the date of ownership. This date will be confirmed with the winner in writing following winner acknowledgement of the prize.
   8. Vehicle warranty will vary dependent on the Prize. Warranty and its duration will be confirmed with the winner before delivery.
   9. Any pictures depicting the prizes on any media including press advertisements, posters or TV commercials are indicative only and the actual prize may vary from the depictions. The Promotion does not constitute an endorsement or recommendation of the product being offered as prize.
   10. The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize as stated. The winner will be liable for all costs and expenses not stated relating to claiming the prize.
   11. The winner will not be able to re-sell the vehicle for three months following delivery. Should the winner wish to sell during the first three months, they must obtain the consent of the Promoter by emailing competitions@autotrader.co.uk.
   12. No insurance will be included.
9. Winner Selection: If there is one valid entry received during the Promotion Period which guesses the correct number, they will be declared the provisional Winner, within 5 working days of the end of the Promotion Period. If there is more than one valid entry that correctly guess the number, all of those valid entrants received during the Promotion Period will be entered into a prize draw, to select 1 provisional winner. If there are no valid entries which have guessed the correct number, the valid entry with the closest guess to the correct number will be declared the provisional Winner. If there is more than one valid entry with the closest guess to the correct number, all of those valid entrants received during the Promotion Period will be entered into a prize draw, to select 1 provisional winner. For your total confidence, if required, the prize draw will be conducted by PromoVeritas, the independent promotional verification service, within 5 working days of the end of the Promotion Period.
10. Winner Notification: The provisional winner will be contacted via the social media account used to enter within 7 working days of Winner Selection and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the provisional winner. Once eligibility has been confirmed, the provisional winner will be confirmed as a winner. If the provisional winner does not respond to the initial contact within 14 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner (as selected under clause 9). Reserve winners may have less time to respond.
11. Prize Acceptance: Notification to arrange fulfilment of the Prize will take place within 28 days of acceptance of the Prize. In the unlikely event that a winner has not received communication to arrange their Prize the winner must inform the Promoter by emailing showontheroadpodcast@promowinners.com. If a winner does not do so, the Promoter reserves the right to not reissue the Prize or limit its value at its sole discretion.
12. When the winner is communicating with the Promoter and when collecting the Prize, the Promoter reserves the right in its absolute discretion to withhold the Prize if the winner fails to comply with these Terms and Conditions, the directions of the Promoter or acts in a manner that is dangerous to themselves or to the public or is, in the opinion of the Promoter, anti-social in any manner or which causes a disturbance or nuisance to others. Whilst accepting the Prize the winner must not: be drunk, intoxicated, under the influence of drugs, underage, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, carry laser pens, bring animals (except guide dogs), carry offensive weapons or illegal substances, carry candles, climb any structure, make excessive noise, offer any item for sale, damage the venue or smoke/vape. Failure to comply with these Terms and Conditions may result in the Promoter withholding the Prize.
13. Provided no objection is received, if you are the winner, your surname and county of residence will be made available by the Promoter to anyone enquiring by sending an email request to competitions@autotrader.co.uk one month after the close of the Promotion, for a period of 8 weeks. You can object to your surname or county of residence being published or request for the amount of information being published to be reduced during the Winner Notification process. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on reasonable request.
14. The Promoter may request that the winner participates in publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of prize acceptance.
15. The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry/ies (and any of your associated aliases) will be disqualified. Any Prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:
    1. Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information it consider reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.
    2. Disqualify entries that are not made directly by the individual entering the Promotion.
    3. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
    4. Disqualify bulk entries from individuals, trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.OLItem.
    5. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.
    6. Disqualify entrants who tamper with the entry process.
    7. Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.
    8. Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
16. The Prize is not transferable or exchangeable, unless express consent has been given by the Promoter, and cannot be redeemed for monetary value or for any other form of compensation. If for any reason any element of the Prize is not available, the Promoter reserves the right, at its sole discretion to substitute another prize for it, of equal or greater value.
17. This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering you are providing your information to the Promoter and not to Instagram, and Instagram is not responsible for any element of this Promotion.
18. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits, or loss of opportunity), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS13844) or accepting or using the/a Prize(s) or disappointment or loss of opportunity for not receiving the Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligenceThe Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits, or loss of opportunity), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion (JS13844) or accepting or using the/a Prize(s) or disappointment or loss of opportunity for not receiving the Prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
19. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.
20. All personal data supplied for this Promotion will be used for the purpose of this Promotion and for research and analytical purposes by the Promoter and/or by any agent appointed by it to assist with running the Promotion (including PromoVeritas). Personal data will not be disclosed to an unconnected third party unless your positive consent has been obtained. Your personal data will be handled in accordance with the Promoter’s privacy policy, available at:https://www.autotrader.co.uk/privacy-notice.
21. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.
22. By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.
23. f there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.
24. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales. Residents of Scotland and Northern Ireland may bring proceedings in their own jurisdiction
